Trademark Policy

1. Introduction

This Trademark Policy ("Policy") explains the guidelines and conditions under which The Data Group, LLC ("BusinessRate," "we," "us," or "our") grants permission to use any of our trademarks, including the BusinessRate name, the BusinessRate logo, and all related names, logos, product and service names, designs, and slogans (collectively, the "Marks" or "BusinessRate Trademarks"). By using any of the BusinessRate Trademarks, you agree to comply with this Policy as well as any relevant BusinessRate Terms of Service or other agreements you may have with us.

2. Ownership of BusinessRate Trademarks

"BusinessRate," the BusinessRate logo, and all related names, logos, product and service names, designs, and slogans are trademarks of The Data Group, LLC or its affiliates or licensors. You must not use such marks without the prior written permission of The Data Group, LLC. All other names, logos, product and service names, designs, and slogans referenced on the BusinessRate website are the trademarks of their respective owners.

3. Authorization to Use BusinessRate Trademarks

General Authorization

  • During the term of your advertising or services agreement with The Data Group, LLC (the "Agreement"), we grant you a nonexclusive, non-assignable, and nontransferable license to use the BusinessRate name and BusinessRate trademarks strictly as outlined below and in your Agreement.
  • The validity of this license depends on your account with The Data Group, LLC remaining in good standing. If the Agreement terminates, or if nonpayment or another issue affects your status in our sole discretion, you must immediately cease using all BusinessRate Trademarks.

Use of the BusinessRate Name

  • You may display the BusinessRate name in advertisements or marketing materials provided (or specifically approved) by us.
  • You may display the BusinessRate name on your website, but only within the scope of the permission in this Policy (see Section 5).

Use of the BusinessRate Logo

  • If your Agreement permits, you may advertise your BusinessRate status by using the BusinessRate logo (the "Logo") as provided by us.
  • You must not alter the Logo in any way. If you need to resize it, you must obtain prior written permission. Any resized Logo must (a) maintain the same proportions, (b) remain legible, and (c) meet any minimum pixel dimensions we specify.
  • Nothing in this Policy or your use of the Logo grants you any ownership or proprietary right in the BusinessRate name or Logo, beyond the limited license granted here.

Advertising BusinessRate Rating

  • You may advertise your BusinessRate rating within the permissions granted below. If your BusinessRate rating changes, you must immediately update or correct any advertisement referencing your old rating.
  • We encourage you to include the Logo (and a statement of BusinessRate affiliation, if permitted) when promoting your BusinessRate rating.

4. Restrictions and Prohibited Uses

Duration of License

  • Your license to use the BusinessRate Trademarks is valid only during the term of your Agreement and while your account remains in good standing.
  • You must cease all usage if your license ends for any reason.

No Endorsement or Preference

  • You may not reference BusinessRate in a way that suggests your products/services are endorsed, sanctioned, or preferred by BusinessRate.
  • Prohibited references include (but are not limited to):
    • "Member, BusinessRate"
    • "Registered with BusinessRate"
    • "Check our record with BusinessRate"
  • You may only use official statements or ads that we create or approve.

No Unauthorized Advertising

You must not use the BusinessRate name, Logo, or other Trademarks in any ads that we have not created or approved, including on social media (LinkedIn, Facebook, Instagram, X/Twitter) unless explicitly approved.

No Misleading Franchise Representations

A franchisor's license does not extend to its franchisees. Each franchisee must obtain its own license from The Data Group, LLC. A franchisor's website must not mislead consumers into believing its franchisees also hold a BusinessRate license unless each franchisee has done so.

Trademark Symbol and Disclaimer

  • When using BusinessRate or the BusinessRate Logo, include the ® symbol (if applicable) or any other trademark symbol we designate.
  • If you use a BusinessRate Trademark in any medium that we didn't provide, you must add a disclaimer (e.g., on your website):

"BusinessRate and the BusinessRate Logo are registered trademarks of The Data Group, LLC."

5. Scope of Permission

Online Advertising

  • Placement: You may display the BusinessRate Logo on your business website and approved online platforms only if (a) the Logo is up to date, (b) it links to your BusinessRate Business Review page, and (c) such display is authorized by BusinessRate or your Agreement.
  • Size and Clarity: If you resize the Logo, it must remain legible and keep its original proportions. No distortion or alteration.
  • Rating Display: You may display your BusinessRate rating on your website, provided you can immediately revise it if your rating changes.
  • Hyperlink: Any use of the BusinessRate Logo online should link to your official BusinessRate listing or review page on BusinessRate.com (if available).

Prohibited Uses

  • References that imply endorsement ("preferred by BusinessRate" or "approved by BusinessRate") are not permitted unless covered by a specific endorsement agreement.
  • Do not manipulate or combine the BusinessRate Logo with other designs, wording, or images without our express written consent.

6. Termination of Trademark License

Termination by BusinessRate

  • We may terminate your license to use the BusinessRate Trademarks at any time if, in our sole discretion, you breach this Policy or your Agreement.
  • Upon termination, you must immediately stop using the BusinessRate Trademarks.

Effects of Termination

All rights granted under this Policy cease immediately upon termination. Any continued use of the BusinessRate Trademarks after termination violates our intellectual property rights.

7. Disclaimer and Indemnification

Disclaimer: BusinessRate provides its Trademarks "as is" and makes no warranties regarding use, validity, or enforceability.

Indemnification: You agree to defend, indemnify, and hold harmless The Data Group, LLC from any claims related to your misuse of BusinessRate Trademarks in violation of this Policy or applicable law.

8. Modifications to this Policy

We may update or modify this Policy at any time. Changes will be posted with a new effective date. Your continued use of our Trademarks after the updates become effective constitutes acceptance of the changes.
